Major PPP Transactions

A widely accepted definition of Public Private Partnerships developed by the United States Federal Highway Administration provides as follows:

“Contractual agreements between public and private entities that expand traditional private sector role in the delivery of infrastructure projects.”1

Our involvement in PPPs can be summarized by sector and geographic region as follows:

1Definition from the Federal Highway Administration, available at https://www.fhwa.dot.gov/ipd/p3/faqs/.

The Depth and Breadth of our Experience:

The firm is experienced in a range of PPP transactions including the following:

We have been involved in or executed transactions involving substantially all of the variations described above.

Note in particular that Public Private Partnership models involve the assumption of more risk by the private sector with greater involvement than the traditional Design-Build and Design-Bid-Build models.

Critical aspects of PPPs:

Although there are a number of key elements that are critical in structuring PPPs, we believe the following areas always need particular attention:

  • Elements that underpin the financing of a PPP.
  • A value for money analysis to ensure the host government, other state entity, or the public achieves the optimal combination of benefits and costs for services as compared to traditional public procurement.
  • Risk allocation.
